A Local Land Charge is a restriction or obligation on future owners of a property. A Full Local Authority Land Charges Search should be carried out when a property or piece of land is put on the market, purchased, leased or valued.

A Full Local Authority Land Charges Search comprises of LLC1 Form (Register of Local Land Charges) and CON29R Form (Enquiries of the Local Authority.) A CON29O Form is also available for optional enquires.

The Local Land Charges Section is responsible for maintaining the Register of Local Land Charges and carries out all Official Searches covered by the Local Land Charges Act 1975, guaranteeing comprehensive replies to the Official LLC1 and CON29R/O enquiries.

What is contained in a Local Authority Search?

LLC1 – The Official Certificate of Search

This reveals the entries on the Land Charges Register. This would include (if applicable to the property):

  • Tree preservation orders
    • Listed buildings
      • Conservation areas since 1974
        • Smoke control areas
          • Conditional planning permissions
            • Financial charges registered against the property
              • Enforcement notices

CON29R – The Enquiries of Local Authorities Form

This includes:

  • Planning history
    • Building control regulations
      • Highway information (including road schemes)
        • Proposed tree preservation orders
          • Proposed enforcement or breach of condition notices

Many of these replies are not to be found on Statutory Public Registers.

CON290 – The Optional Enquiries of Local Authorities Form

This includes:

  • Public footpaths and byways
    • Gas pipelines
      • Common land enquiries

How to request a search

Printed Forms

Send forms LLC1 and CON29R/O via the post or DX system (Addresses are at the top of this page). There are full instructions for completion on the forms. Your solicitors will have these forms or they can be obtained from law stationers. We will also require three plans with the property to be searched clearly outlined in red. The fee should be paid by cheque made payable to Dacorum Borough Council.

Personal searches

A personal search is an inspection of the Local Land Charges Register. Personal searches can be made by members of the public or their Agent on payment of the statutory fee of £22, but by appointment only.

From 1 April 2009 Dacorum Borough Council will also make available replies to CON29R Enquiries.
